Paolo Ardoino serves as chief technology officer while running Tether, and the corporate family has been consolidating around El Salvador, where the derivatives platform's operating entity is incorporated.

Bitfinex Perpetual Futures Fees

Bitfinex derivatives fees start at 0.02% maker and 0.065% taker for accounts below $2 million in 30-day volume, per the official fee schedule. The ladder scales through volume brackets until makers above $3 billion earn a -0.015% rebate while paying 0.02% as takers, an unusually deep rebate that reflects the exchange's courtship of market makers.

LEO holdings cut rates on top of the volume tiers, trimming taker fees by up to 0.02% and maker fees by up to 0.005% depending on the size of the position held. LEO itself began life as the debt token issued after the exchange's 2019 balance sheet crisis, which gives the discount program a stranger backstory than any rival's loyalty scheme. Fees apply to notional value, and liquidations forfeit the position's collateral rather than charging a separate percentage fee.

How Bitfinex Funding Rates Work

Bitfinex settles derivatives funding three times daily at 00:00, 08:00, and 16:00 UTC, with each 8-hour window serving as the funding period. The rate derives from the average spread between the mark price, set by the BFXCI index, and the derivative's mid-price across the whole period, so a contract that trades rich for six hours then normalizes still generates a payment, unlike snapshot systems that only sample the deadline.

The methodology also permits genuine 0% funding periods when the average spread stays inside the neutral band, so flat prints here carry information rather than indicating stale data. One mechanical detail matters for leveraged accounts, since funding owed is debited from a position's allocated collateral when the derivatives wallet runs short, which erodes the margin cushion and drags the liquidation price closer. Bitfinex Perpetual Contract Types & Leverage

Bitfinex perpetuals are denominated in USDt or BTC and run on isolated margin exclusively, with each position holding its own allocated collateral rather than sharing a cross-margined pool. Minimum collateral is 1% of notional, which sets the 100x maximum leverage, and maintenance margin bottoms out at 0.5% before liquidation forfeits the position's collateral into the Liquidation Fund.

The isolated-only design reads as a deliberate philosophy, containing each position's blowup radius at the cost of capital efficiency, the opposite bet from the unified accounts sweeping the sector. Bitfinex runs one of the broadest TradFi perpetual menus of any centralized exchange, all through Bitfinex Derivatives El Salvador, S.A. de C.V. and all settled in USDt. Tether Gold perps trade alongside silver, UK crude oil, palladium, and platinum contracts, with FX perpetuals covering the euro, yen, and sterling, plus equity and volatility products, and headline leverage reaches 100x even on gold.

Bitfinex Licenses & Regulation

Bitfinex's enforcement history is substantial and precisely documented. In February 2021 the New York Attorney General settled with iFinex, Bitfinex, and Tether for $18.5 million over the concealment of $850 million in funds lost with payment processor Crypto Capital and misstatements about Tether's reserves, banning both companies from serving New Yorkers, as reported by CNBC. In October 2021 the CFTC ordered the two companies to pay a combined $42.5 million, with $41 million assessed against Tether over reserve misstatements and the remainder against Bitfinex's operating entities for illegal off-exchange retail commodity transactions with US persons.

Current licensing sits with affiliated entities, a digital asset service provider registration in El Salvador and an Astana International Financial Centre footprint in Kazakhstan held through the securities arm. Bitfinex holds no MiCA authorization and does not appear on the ESMA register, leaving EEA retail outside the licensed perimeter after the bloc's July transition, and no formal exit announcement matching those published by capitulating rivals has surfaced.

Where is Bitfinex Available?

Bitfinex excludes the United States and Canada outright, restricts non-exempt United Kingdom persons, and blocks embargoed jurisdictions including Cuba, North Korea, Iran, Syria, Crimea, and the occupied Ukrainian regions, per its own terms of service. Derivatives carry a narrower eligibility gate than spot, requiring verification and excluding every restricted jurisdiction from the entire 60-contract perpetual menu.

For derivatives specifically that means zero US access under the CFTC order's shadow, no UK retail access under FCA rules, and an unlicensed position in the EEA following MiCA's transition, leaving the active base concentrated across Latin America, Asia, and other unrestricted markets. KYC applies to derivatives accounts even where spot verification tiers are lighter.

Is Bitfinex Safe?

Bitfinex survived the largest exchange theft of its era and repaid it. In August 2016 attackers stole 119,754 BTC, roughly $72 million then, despite BitGo multi-signature custody, and the exchange socialized the damage with a 36% haircut across all accounts, issuing BFX tokens that were fully redeemed for cash or iFinex equity within eight months. The US government seized 94,643 of those coins in 2022 from the couple convicted of laundering them, and a court has ordered the stash, worth roughly $9 billion at the ruling, returned to Bitfinex in kind, with the government still executing transfers as of this spring, per CoinDesk. Bitfinex has pledged 80% of recovered funds to buying back and burning LEO.

There is no Merkle tree Proof of Reserves program, and Tether's quarterly attestations cover the stablecoin issuer rather than the exchange, a distinction worth keeping sharp. The derivatives platform publishes its insurance fund balance live through the public API, most client assets sit in multi-signature cold storage, and account controls include U2F hardware keys and withdrawal whitelisting. A repaid hack a decade old is a better record than most, and counterparty risk on any centralized venue never reaches zero.
